ABSTRACT
Disputes are inevitable in the construction industry as in other areas of human endeavours. Disputes, if not well managed can lead to loss of valuable time, money and ultimately the abandonment of the project. This study was carried out to determine the causes of dispute, the various dispute resolution techniques, the factors affecting the choice of a technique as well as their effect on project performance in the Edo State construction industry. A total of 218 questionnaires were administered to the respondents and 55% of them were completed, returned, and found useful. Data garnered were analysed, presented and ranked using mean item score and percentages. Disputes were seen to be unfavourable to project performance with time and cost affected the most. Litigation was found to have the most adverse effect on the duration and cost of the project as it is slow, and the most expensive of the dispute resolution techniques. Alternative Dispute Resolution techniques like Mediation were found to be better as they were faster and cheaper. Nevertheless, Alternative Dispute Resolution techniques are not widely used as litigation and arbitration, this shows the need for seminars, conferences, and workshops to widely educate the stakeholders on the benefits of the Alternative Dispute Resolution techniques.
